सुप्रीम कोर्ट अविवाहित महिलाओं को गर्भपात की अनुमति देने को लेकर कानून में बदलाव करने पर विचार करेगा। सुप्रीम कोर्ट के अनुसार एक अविवाहिता महिला को सुरक्षति गर्भपात के अधिकार से वंचित करना उसकी व्यक्तिगत आजादी है।ऐसे में कोर्ट अब मेडिकल टर्मिनेशन ऑफ प्रेग्नेंसी (एमटीपी) अधिनियम और संबंधित नियमों की व्याख्या करेगा कि क्या अविवाहित महिलाओं को 24 सप्ताह के गर्भपात की अनुमति दी जा सकती है या नहीं।न्यायमूर्ति डी वाई चंद्रचूड़ और न्यायमूर्ति जेबी पारदीवाला की पीठ ने शुक्रवार को केंद्र की ओर से पेश अतिरिक्त सॉलिसिटर जनरल ऐश्वर्या भाटी को इस प्रक्रिया में अदालत की सहायता करने को कहा।सुनवाई के दौरान न्यायमूर्ति चंद्रचूड़ ने कहा कि जब कानून के तहत अपवाद प्रदान किए गए हैं, तो अविवाहित महिलाओं को 24 सप्ताह की गर्भावस्था को समाप्त करने के लिए शामिल क्यों नहीं किया जा सकता है। हालांकि हमे इसके लिए डॉक्टर की सलाह को तरजीह जरूर देना चाहिए। उन्होंने आगे कहा कि संसदीय मंशा स्पष्ट प्रतीत होती है क्योंकि इसने “पति” को “साथी” के साथ बदल दिया है. यह दर्शाता है कि उन्होंने अविवाहित महिलाओं को भी 24 सप्ताह के गर्भ को समाप्त करने की अनुमति देने वालों की श्रेणी में रखा है।

नई दिल्ली। सुप्रीम कोर्ट ने चिंता जताते हुए बताया कि देश में मेडिकल की पढ़ाई काफी महंगी है, इसी कारण खर्च नहीं उठा पाने वाले छात्रों को मेडिकल की पढ़ाई के लिए यूक्रेन, कजाकिस्तान जैसे अन्य देशों में जाना पड़ रहा है। सुप्रीम कोर्ट ने कहा कि आने वाले समय में देश को डॉक्टरों की काफी जरूरत है, और ऐसे में इस तरह की घटना काफी डराने वाली स्थिति पैदा करती है। देश को नए-नए मेडिकल कॉलेज चाहिए जिनमें मेडिकल की सीट ज्यादा हो और फीस कम जिससे कि गरीब वर्ग के बच्चे भी मेडिकल की पढ़ाई कर सकें व अपने देश में आने वाली बीमारियों व चुनौतियों का सामना कर सकें।

डॉक्टरों के किया अपना प्रचार तो रद्द होगा लाइसेंस

मेडिकल कौंसिल ऑफ़ इंडिया के कंडक्ट कोड के अनुसार कोई भी डॉक्टर अपना प्रचार प्रसार नहीं कर सकता है तथा कोई भी अस्पताल इस तरह का प्रचार नहीं कर सकता है की हमारे यहाँ ये ये चिकित्सक उपलब्ध हैं ।
इसके बजाय अस्पताल इस तरह का प्रचार कर सकते हैं कि उनके यहाँ क्या क्या सुविधाएँ उपलब्ध हैं और कौन कौनसी विशेज्ञता के चिकित्सक उपलब्ध हैं ।

अतः सभी अस्पतालों और चिकित्सकों से अपील है की वे नियमानुसार ही प्रचार प्रसार करें अन्यथा फालतू की क़ानूनी पेचीदगी में फंस सकते हैं ।

Section 6.1 of the MCI code makes it a crime. According to the code,

‘Soliciting of patients directly or indirectly, by a physician, by a group of physicians or by institutions or organisations is unethical. A physician shall not make use of him / her as subject of any form or manner of advertising or publicity through any mode either alone or in conjunction with others which is of such a character as to invite attention to him or to his professional position, skill, qualification, achievements, attainments, specialities, appointments, associations, affiliations or honours and/or of such character as would ordinarily result in his self-aggrandizement. A physician shall not give to any person, whether for compensation or otherwise, any approval, recommendation, endorsement, certificate, report or statement with respect of any drug, medicine, nostrum remedy, surgical, or therapeutic article, apparatus or appliance or any commercial product or article with respect of any property, quality or use thereof or any test, demonstration or trial thereof, for use in connection with his name,  signature, or photograph in any form or manner of advertising through any mode nor shall he boast of cases, operations, cures or remedies or permit the publication of report thereof through any mode.’

Fate of 150 Medical Students in MP College Uncertain, SC Asks MCI for Solution

The Supreme Court has taken a serious note of 150 medical students in Bhopal being left in the lurch after permission of a college for admission in the academic session 2017-18 was denied by the Medical Council of India (MCI).

New Delhi: The Supreme Court has taken a serious note of 150 medical students in Bhopal being left in the lurch after permission of a college for admission in the academic session 2017-18 was denied by the Medical Council of India (MCI).
The top court has asked the MCI to suggest a solution to thwart the crisis and place on record the details of vacant seats in Madhya Pradesh and adjoining states for the academic session 2017-18.
A vacation bench of justices U U Lalit and Deepak Gupta expressed concern of the situation and wondered as what should be the approach to deal with the matter where the students were allocated seat by the central counselling agency to a particular college, which had later ran into difficulties.
“It is not as if the admissions in question were not in fair and transparent manner. On the other hand, the state authorities sent or directed the students to this college. Can the students be now left in the lurch,” the bench asked.
During the hearing, advocate Arjun Garg, appearing for the Madhya Pradesh government, said not a single seat was available in any of the medical colleges in the state for the academic session 2017-18.
The bench asked Garg on whose instructions he has been making such a statement and warned that if at a later stage, the submission was found to be wrong, it would haul up the official concerned. Garg said he has instructions from additional chief secretary for medical education in the state and named the official as R S Julani.
“The correctness of that statement will certainly be considered but at this stage it must be stated that the status report on record filed on behalf of the state of Madhya Pradesh on May 2, 2018 does not indicate the stand which is now projected on behalf of the state of Madhya Pradesh,” it said.
It said that the MCI should place its view in the matter and suggest a solution, if any.
“We also direct the MCI to place before us the details as to vacant seats available in colleges in state of Madhya Pradesh and adjoining states for the academic session 2017-2018. The MCI shall file appropriate affidavit within two weeks giving complete details of vacancy situation as indicated above,” the bench said.
It listed the matter immediately on reopening before the appropriate bench and sought response from Directorate General of Health Services (DGHS).
The top court was hearing a matter related to RKDF Medical College Hospital and Research Centre which was initially accorded approval by the MCI and the Centre to take admissions for MBBS course for academic session 2014-15.
However, after the inspection was undertaken by the MCI for the next academic session (2015-2016), no renewal permission was granted and the college was debarred from making any admissions.
The college again was allowed to admit students for academic session 2016-17 but denied permission for academic session 2017-18.
However, through an interim order, the apex court granted permission to take admission of 150 students for academic session 2017-18.
The entire batch of 150 students was admitted and all admissions were made pursuant to the allocations of seats made by the state authorities through the central counselling agency.
“The facts on record indicate that the renewal permission for the academic session 2017-2018 was finally not granted, which has, therefore, left the question to be considered as to the status and the rights of those students who were admitted pursuant to the interim order and who were allocated by the central counselling agency,” the bench said.
The top court said that one of the terms of essentiality certificate under which a college is allowed to be set up and make admissions is that in case the college runs into any difficulty, the state shall take care of those students who were admitted in such college.
The bench said that the top court had expressed its concern over the fate of students through its interim order passed from time to time and said that the students in question must be accommodated in other colleges firstly in Madhya Pradesh and if not, then in the adjoining states.

GUIDELINES   FOR   ARREST

 

The  Hon’ble  Supreme  Court  of  India   in  the  matter  of Joginder Kumar  Vs   State  of UP  ( Crl. WP No. 9 of 1994 )  made  the  following  observations:-

 

  1. No arrest can be made because it is lawful for the Police Officer to do so. The existence of the power to arrest is one thing.  The justification for the exercise of it is quite another.  The Police Officer must  be  able to justify the arrest apart from his power to do so.

 

  1. No arrest can  be  made  in a routine  manner  on  a  mere  allegation of commission of an offence made against a person……… no arrest should be made  without  a  reasonable  satisfaction  reached  after  some  investigation as to the genuineness and bona fides  of  a complaint and  a  reasonable  belief both as to the person’s complicity and even so as to the need to effect arrest.

 

  1. A person is not liable to arrest merely on the suspicion of complicity in an offence. There must be some reasonable justification in the opinion of the Officer effecting the arrest that such arrest is necessary and justified.

Non Practicing Allowance NPA

  • Non – Practising Allowance NPA Definition

Non – practising allowance is given to the Doctors who are working under central government health centres, railways or in other departments of union/state government. A medical officer who is not interested in practicing from home can ask for such allowance. This allowance is considered as equivalent to the Dearness Allowance or Housing Rent Allowance. The amount of non – practicing allowance is calculated on the basis of basic pay plus grade pay. The HRA is calculated on the basis of basic pay plus NPA*. On the other the pension is also calculated on the basis of NPA.

* In seventh pay commission House rent allowance is NOT given on NPA amount.

NPA is also provided to the medical officers who are in leave for higher study. To get the non – practicing allowance, a medical officer must have a minimum medical degree certification. If the candidate wants to pursuit higher studies, he /she can grant for NPA during their study leave.

  • Non – Practicing Allowance Calculations (6 CPC)

Non – practicing allowance is calculated on the basis of the basic pay of a medical officer. The basic pay includes the grade pay as well. After 6th pay commission the NPA was set at 25% of the basic pay.

For example:

Let a medical officer draws basic pay of Rs. 15, 600/- and Grade Pay of Rs. 5400/- and the NPA rate is 25%. Then the Non – practicing allowance for the officer will be,

Total Pay: 15,600 + 5400 = 21, 000/-

NPA Rate: 25% of the basic pay scale

NPA amount: 21, 000/- x 25% = 5250/-

Total NPA = 25% of Basic Pay + DA on It = 5250/- + DA on 5250/- 🙂

  • Non – Practicing Allowance Calculations (7 CPC)

Non – practicing allowance is calculated on the basis of the basic pay of a medical officer. The basic pay includes the grade pay as well. After 7th pay commission the NPA set at 20% of the basic pay.

For example:

Let a medical officer draws basic pay of Rs. 70000 /- and the NPA rate is 20%. Then the Non – practicing allowance for the officer will be,

NPA amount: 70, 000/- x 20% = 14000/-

Total NPA = 20% of Basic Pay + DA on it = 14000/- + DA on 14000/- 🙂

Tips –

Whether NPA payable to medical officers will count towards ‘Pay’ for the purpose of working out contributions to NPS?

Yes. Ministry of Health & Family Welfare has clarified vide their O.M. no. A45012/11/97-CHS.V dated 7-4-98 that the Non-Practising Allowance shall count as ‘pay’ for all service benefits. Therefore, this will be taken into account for working out the contribution towards the New Pension Scheme.

Medical Officers are granted Non Practicing Allowance at the rate of 25% of basic pay (6 CPC) subject to condition that pay plus Non Practicing Allowance does not exceed Rs.29500/-p.m. vide this Ministry’s letter No. A.45011/11/97-CHS V dated 7.4.98. Non Practicing Allowance is treated as Pay for all service matters. In other words it is taken into account for computation of D.A., entitlement of T.A./D.A. and other allowances as well as for calculation of retirement benefits in terms of letter No. A.27023/1/87-CHS V dated 22.9.1987.

Non – practising allowance is not a regular allowance like HRA, DA or TA. To receive this allowance one needs to fulfil some criteria. The main criterion to receive the NPA is to have a minimum medical degree from a recognised organisation. Also as per the rules whoever is receiving the NPA shall not be involved in any private practice during their service, leave or after retirement. The NPA is considered to be an important part while calculating HRA and also Pension after the retirement. Of course the non – practising allowance is not for all. To receive this allowance, candidate must apply to the organisation separately.
